MAN RETURNS TO HIS LAND TO FIND A $1.5 MILLION HOUSE BUILT ON IT

When a man returned to a plot of land he owned and found a four-bedroom house on it, he was perplexed. The site at 51 Sky Top Terrace in Connecticut has been held by Dr. Daniel Kenigsberg for more than 30 years, and even though it was vacant, he had plans for it. His land appeared to be in good condition for thirty years until a friend informed him that construction had started on the half-acre site. As you might guess, Dr. Kenigsberg was taken aback when he stated that the mysterious construction was constructed unlawfully because he had never sold the site.


So, with that news, he decided to pop on over to see for himself what was supposedly being built on his property. It was a massive house, freshly built and yet to be occupied. The land that the doctor had bought was sold to 51 Sky Top Partners LLC for $350,000 in October 2022, according to official records, although Dr. Kenigsberg was unaware of this. He actually claimed that he was unaware of the sale and had nothing to do with it. The house was apparently under contract with a buyer and was listed for $1,475,000 on the market.


In the end, he chose to bring legal action against the local developer, the Trumbull attorney, and the firm they worked for that facilitated the false closure. They were sued by Dr. Kenigsberg on nine counts, including unfair trade practices, statutory theft, and trespassing. The lawsuit, which was filed in July 2023, was seeking to make the sale of the land void and Dr Kenigsberg was looking for damages in the sum of $2 million. Additionally, he required that the aforementioned corporation remove "any constructions and/or materials from the Property and restore the Property to the condition that it was in previous to Defendants' trespass onto it."

"I'm angry that so many people were so negligent that this could have happened," the disgruntled landowner said at the time. "It's more than obnoxious - it's offensive and wrong."




The developer later sued the lawyer who concluded the deal once it was discovered that the land they had bought was a part of a swindle. According to court records, the fraudster first got in touch with the attorney and firm. In response, 51 Sky Top Partners released the following statement: "We discovered to our surprise and dismay that Kenigsberg had not actually sold the property to us. "Instead, a third party had assumed the identity of Kenigsberg and, thanks to the negligence and carelessness of the different real estate agents engaged in the deal, was able to list, market, and sell the house without anybody ever noticing."




Dr. Kenigsberg filed a lawsuit against the builders, Anthony Monelli, and the Trumbull attorney involved in the land sale. But according to CT Insider, the builders then sued their attorney, Monelli, as well as the real estate firm and agent that put the property up for sale in 2022. Following a brief conflict, a settlement was made in the spring that gave Sky Top Partners a title to the land and Dr. Kenigsberg an unknown amount. They were then allowed to complete the house and sell the four-bedroom home. Only a year after Dr. Kenigsberg's lawsuit, the house sold for $1.45 million, which is less than its original asking price.


As for the investigation into the scammer, Fairfield Police turned the case over to the FBI, and it has yet to reach a resolution.
